Terms of service
Overview
This website and online store are operated by TARITOA INC under the brand name Taritoa. Throughout these Terms of Service, the terms “Taritoa,” “we,” “us,” and “our” refer to TARITOA INC.
Taritoa offers this website, including all information, content, features, tools, products, and services available through the website, collectively referred to as the “Services,” subject to your acceptance of these Terms of Service.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and Services to you.
By accessing, browsing, or using any part of the Services, or by purchasing a product from us, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Services.
Section 1 – Eligibility and Account Use
By using the Services, you confirm that you are at least the age of majority in your state or jurisdiction of residence, or that you have obtained the consent required for a minor dependent to use the Services.
You agree to provide accurate, current, and complete information when creating an account, placing an order, or communicating with us.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You must notify us promptly if you suspect unauthorized access.
You may not sell, transfer, assign, or share your account in a way that violates these Terms or applicable law.
Section 2 – Products and Product Information
We make reasonable efforts to display product descriptions, measurements, colors, photographs, and other information accurately.
However, the appearance and color of products may vary depending on your screen, lighting, production variations, materials, and other factors. We do not guarantee that the display on your device will perfectly match the physical product.
Product descriptions, prices, availability, specifications, and quantities may be changed without notice.
We reserve the right to discontinue a product, limit available quantities, restrict sales, or refuse a transaction where permitted by law.
Section 3 – Orders
Submitting an order constitutes an offer to purchase the selected products. We reserve the right to accept, reject, limit, or cancel an order where permitted by law.
An order is not considered accepted until payment has been successfully processed and we issue an order confirmation or begin fulfillment.
We may reject or cancel an order for reasons including:
- Product unavailability;
- Pricing or product-information errors;
- Payment authorization failure;
- Suspected fraud or unauthorized activity;
- Shipping restrictions;
- Unusually large quantities; or
- Violation of these Terms.
If we cancel a paid order, we will issue an appropriate refund to the original payment method.
You are responsible for reviewing product selections, quantities, addresses, and payment information before submitting an order.
Section 4 – Pricing, Taxes, and Payment
Prices, discounts, and promotions may change without notice. The applicable product price is the price displayed when the order is submitted, subject to correction of obvious errors.
Shipping charges and applicable taxes will be displayed during checkout where required.
By submitting payment information, you represent that:
- The information is accurate and complete;
- You are authorized to use the selected payment method; and
- You authorize us and our payment providers to charge the applicable order total.
We may use third-party payment processors. Your use of a payment method may also be subject to the payment provider’s terms and privacy practices.
Section 5 – Shipping and Delivery
Shipping options, processing times, estimated delivery periods, fees, and geographic limitations are described in our Shipping Policy.
All processing and delivery dates are estimates unless expressly stated otherwise.
We are not responsible for delays caused by carriers, weather, public emergencies, incorrect addresses, peak shopping periods, or other circumstances outside our reasonable control. This limitation does not affect any non-waivable rights available under applicable law.
Section 6 – Returns and Refunds
Returns, refunds, damaged-product claims, and cancellation requests are governed by our Refund & Return Policy.
You agree to follow the stated return-authorization procedures before sending a product back.
Section 7 – Intellectual Property
All content and materials made available through the Services, including text, product descriptions, photographs, graphics, illustrations, videos, audio, logos, icons, trademarks, software, page layouts, and website design, are owned by or licensed to Taritoa and are protected by applicable intellectual-property laws.
You may access and use the Services only for personal, lawful, and non-commercial purposes.
Without prior written permission, you may not:
- Copy, reproduce, modify, publish, distribute, sell, or exploit website content;
- Remove copyright, trademark, or ownership notices;
- Use our branding in a way that suggests sponsorship or endorsement;
- Create derivative works from protected content; or
- Use website content for unauthorized commercial purposes.
No provision of these Terms transfers ownership of intellectual property to you.
Section 8 – Optional and Third-Party Tools
We may provide access to tools, applications, integrations, or services operated by third parties.
Third-party tools are provided on an “as is” and “as available” basis. We do not control or guarantee their availability, accuracy, security, or performance.
Your use of third-party tools is at your own discretion and may be subject to separate third-party terms and privacy policies.
Section 9 – Third-Party Links
The Services may include links to third-party websites or content. We are not responsible for evaluating or guaranteeing third-party content, products, services, policies, or security.
Accessing a third-party website is at your own risk. Any transaction with a third party is solely between you and that third party.
Section 10 – Relationship with Shopify
Our store is powered by Shopify, but purchases made through the Services are transactions between you and TARITOA INC.
Shopify is not the seller of products offered by Taritoa and is not responsible for product quality, order fulfillment, delivery, returns, refunds, or customer-service claims relating to purchases from us.
Your use of Shopify-powered features may also be subject to Shopify’s applicable terms and privacy practices.
Section 11 – Privacy
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Because our store is hosted by Shopify, information may also be processed by Shopify and its service providers as necessary to operate and improve the ecommerce platform.
Section 12 – Reviews, Comments, and Feedback
If you submit a review, comment, photograph, suggestion, idea, or other content to us, collectively referred to as “Feedback,” you grant Taritoa a worldwide, non-exclusive, royalty-free, transferable, sublicensable, and perpetual license to use, reproduce, adapt, publish, translate, distribute, and display the Feedback for lawful business purposes.
You represent that:
- You own or control the rights necessary to submit the Feedback;
- The Feedback is accurate and based on genuine experience where presented as a review;
- The Feedback does not infringe the rights of another person;
- The Feedback is not unlawful, defamatory, deceptive, abusive, or malicious; and
- The Feedback does not contain malware, spam, or unauthorized advertising.
We may moderate, decline, or remove Feedback where permitted by law.
Section 13 – Errors, Inaccuracies, and Omissions
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.
We reserve the right to correct errors, update information, and cancel affected orders where permitted by law, including after an order has been submitted.
Section 14 – Prohibited Uses
You may not use the Services to:
- Violate any applicable law or regulation;
- Infringe intellectual-property, privacy, publicity, or other rights;
- Submit false, fraudulent, or misleading information;
- Harass, threaten, defame, abuse, or discriminate against another person;
- Transmit malware, viruses, harmful code, or destructive technology;
- Collect personal information about other users without authorization;
- Send spam, phishing messages, or unauthorized commercial communications;
- Scrape, crawl, index, extract, or copy data without authorization;
- Use bots or automated tools in a manner that interferes with the Services;
- Bypass or interfere with security features or access controls;
- Impersonate another person or organization;
- Place fraudulent orders or use an unauthorized payment method; or
- Interfere with the operation, security, or integrity of the Services.
We may suspend or terminate access where we reasonably believe these Terms have been violated.
Section 15 – Termination
You may stop using the Services at any time.
We may suspend or terminate access to the Services where permitted by law, including in response to suspected fraud, unlawful activity, misuse, security threats, or material violation of these Terms.
Termination does not affect provisions that by their nature should survive, including intellectual-property rights, payment obligations, disclaimers, limitations of liability, indemnification, and governing law.
Section 16 – Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Except for warranties that cannot legally be excluded, we disclaim express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.
We do not guarantee that the Services will always be available, uninterrupted, secure, timely, accurate, or error-free.
Some jurisdictions do not permit certain warranty exclusions, so some of these provisions may not apply to you.
Section 17 – Limitation of Liability
To the fullest extent permitted by applicable law, TARITOA INC, Taritoa, and their officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Services or purchase of products.
This includes, where permitted by law, loss of profits, revenue, savings, business opportunities, data, goodwill, or replacement costs.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Section 18 – Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless TARITOA INC, Taritoa, Shopify, and their respective affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:
- Your material violation of these Terms;
- Your unlawful use of the Services;
- Your infringement of another person’s rights; or
- Content or Feedback you submit through the Services.
Section 19 – Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain effective.
Section 20 – Waiver and Entire Agreement
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with policies referenced on the website, constitute the entire agreement between you and Taritoa concerning use of the Services and supersede prior communications relating to the same subject matter.
Section 21 – Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other lawful business transaction.
Section 22 – Governing Law
These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Colorado and applicable federal laws of the United States, without regard to conflict-of-law principles.
Subject to any rights you may have under applicable consumer law, disputes shall be brought before courts with appropriate jurisdiction in Colorado.
Section 23 – Headings
Section headings are provided for convenience and do not affect the interpretation of these Terms.
Section 24 – Changes to These Terms
We may update these Terms from time to time by posting a revised version on this page.
The revision date will be updated when material changes are made. Your continued use of the Services after updated Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.
